1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the website wyldforest.com and your purchase of products, tours, and services from Wyldforest GmbH, a German limited liability company ("Wyldforest", "we", "us", "our"). By accessing our site or purchasing our services, you agree to be bound by these Terms.

2. Products and Services

All descriptions of products, tours, and pricing are subject to change at any time without notice.

  • Booking: Your order constitutes an offer to purchase. A contract is only formed when we send you a confirmation email. We reserve the right to refuse or cancel any order for any reason, including pricing errors.

  • Nature of Services: Our tours are guided outdoor experiences. We cannot guarantee the quantity or variety of foraged items found, as this depends on nature and weather conditions.

3. Gift Cards

Gift cards are valid for three (3) years from the date of purchase. Gift cards are not redeemable for cash (except where required by law) and cannot be replaced if lost or stolen.

4. Cancellation and Rescheduling Policy

  • By Wyldforest: We reserve the right to cancel or reschedule tours due to dangerous weather, insufficient participation, or other "Force Majeure" events. In such cases, you will be offered a reschedule date or a voucher for a future tour.

  • By Customer: All sales for foraging tours and events are final. No refunds will be issued. However, you may reschedule your booking or exchange it for a voucher up to 3 days (72 hours) before the event. Cancellations made less than 72 hours in advance result in a full forfeiture of the booking fee.

5. ASSUMPTION OF RISK & RELEASE OF LIABILITY

PLEASE READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS. By booking or participating in any Wyldforest tour, you acknowledge:

  • Inherent Risks: You understand that outdoor activities involve risks, including but not limited to: slipping, falling, wildlife encounters, and unpredictable weather.

  • Consumption: Our guides provide educational information only. You are solely responsible for anything you choose to consume. Wyldforest assumes no liability for allergic reactions, illness, or death resulting from the consumption of foraged items.

  • Release: To the fullest extent permitted by law, you release Wyldforest GmbH (Germany) and its agents from any and all liability or claims arising out of injury, loss, or death related to our services. Note: Specific liability waivers for the state of the tour must be signed prior to participation.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WYLDFOREST GMBH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE SERVICE.

7. Governing Law and Jurisdiction

  • Governing Law: Regarding the execution of the tours and liability issues, the laws of the U.S. State in which the service is provided shall apply. For all contractual and general business matters, these Terms shall be governed by the laws of the Federal Republic of Germany.

  • Jurisdiction: Any legal action or proceeding arising out of or related to these Terms or our services shall be brought exclusively in the competent courts located in Karlsruhe/Mannheim, Germany. You hereby consent to the personal jurisdiction of such courts.

8. Arbitration & Class Action Waiver

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration. YOU WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT.
